Uptime Medical reserves the right, in its sole discretion, to correct any errors or omissions of any portion of content, services, or prices described online or written at any time without notice, unless mutually agreed upon in writing.

Limitations of Damages

In no event shall Uptime Medical be liable to any entity for any direct, indirect, special, consequential, or other damages (including, without limitation, any loss of profits, business interruption, or loss of information) that are related to the use of, or the inability to use, the content, materials, and functions online or written, even if Uptime Medical is expressly advised of the possibility of such damages.

Information Provided By You

Our Privacy Policy protects any information you provide to Uptime Medical online or written. You agree that any information or materials that you or individuals acting on your behalf provide to Uptime Medical will not be considered confidential or proprietary. By providing any such information or materials to Uptime Medical, you grant to Uptime Medical an unrestricted, royalty-free license to use, reproduce, display, transmit, and distribute such information and materials. You further recognize that you warrant that you shall not provide any information or materials to Uptime Medical that is defamatory, threatening, obscene, harassing, or otherwise unlawful, or that incorporates the proprietary material of another.

Services

All first time customers must contact Uptime Medical for account setup and generation of a customer number.

Uptime Medical shall not be liable for delay in performance or inability to perform occasioned by any cause beyond its control or beyond the control of its suppliers' inability to obtain parts.

Flat-rate repairs and turnaround times are subject to parts availability. A customer number and name, contact name and phone number, purchase order number, model number, and serial number must be supplied with all units to repair. A $35.00 evaluation fee applies for customers that want their units sent back not repaired. All flat-rate repairs are covered by an Uptime Medical 120-day warranty. This warranty is void if unit has been tampered with or abused. All warranty returns require a return authorization number supplied by calling Uptime Medical. All return authorization items must be visibly marked on the outside of the box and inside with returned item. This also ensures a higher priority for product turnaround.

Exchange items are subject to availability. Item must be returned within 15 days of receipt of item to ensure proper credit. Exchange items require purchase order for item's full replacement cost up front. A customer number and name, contact name and phone number, and purchase order number must be supplied with all exchange units. After unit is returned and meets all requirements, the true exchange rate is applied to the purchase order. Exchange items require device to be deemed complete and repairable. Items with missing parts, burnt circuit boards, abuse, or anything that makes the unit not repairable will result in full replacement cost to the purchase order. Uptime Medical reserves the right to cancel customer exchange orders at any time after notification. Exchange items are covered by an Uptime Medical 90-day warranty. All warranty returns require a return authorization number supplied by calling Uptime Medical. A replacement item will be reordered and a full refund will be applied to the purchase order upon receipt and verification of serial number. If unit has been tampered with or abused, full replacement cost will be applied to purchase order. The return authorization number must be visibly marked on the outside of the box and inside with returned item. Return freight is the customer's responsibility.

Preventive Maintenance service does not offer any repairs of any kind. If device fails testing, the customer will be notified of situation and can be offered our Repair and Return service or Exchange service. Normal PM rate applies for customers that want their units sent back not repaired. The Preventive Maintenance service does not offer a warranty of any kind, as no internal repairs would have been performed.

Uptime Medical has the right to refuse any shipment without meeting the shipping requirements set forth above.
